1. The 14-day consumer right
A consumer entering into a distance contract generally has 14 days from conclusion of the contract to withdraw without giving a reason. For a service contract, exercising the right after performance has started may operate as termination.

2. Digital content not supplied on a tangible medium
Access before the end of the 14-day period is not automatic. Before payment, and separately from accepting the Terms, the customer must expressly request and consent to supply beginning and, in the same statement, acknowledge that this causes the withdrawal right for the digital content to be lost when performance begins. The Provider must confirm the contract and that statement on a durable medium.
If the prior express consent, contemporaneous acknowledgement or required confirmation is missing, the exception for digital content does not apply.
3. A digital or other service element
If the contract contains a separate service element, merely starting performance does not end the withdrawal right. For a paid service, the right may end only when the service has been fully performed, provided that the consumer expressly requested the early start and acknowledged that consequence in advance. If the consumer exercises the right before full performance, a proportionate amount for the service actually provided may be payable where the statutory conditions are met.
EU consumer-law guidance says that, where it is doubtful whether an online contract is for digital content or a service, the service-contract withdrawal rules should apply. The final classification of City Mystery Trail and the checkout wording therefore remain subject to professional legal approval.
4. City Mystery Trail's immediate-performance flow
Checkout uses one combined immediate-performance statement in a single box that is unticked by default and separate from the Terms and Privacy Notice controls. It contains both:
- the customer's express request and consent for immediate digital performance; and
- acknowledgement of the different withdrawal consequences for digital content and for any service element.
The successful-order confirmation reproduces the combined statement's recorded wording, time and version and attaches unchanged copies of the accepted Terms and Privacy Notice. Loss of the withdrawal right never removes statutory remedies for non-conforming digital content or services.
5. Online withdrawal function
The prominently displayed Withdraw from contract here function remains continuously accessible on the website during the withdrawal period. It asks for the consumer's name, an order reference identifying the contract and the email address chosen for the electronic acknowledgement. After reviewing the information, the consumer sends the statement with the “Confirm withdrawal” button.
Immediately after activation of that button, the Provider sends an acknowledgement of receipt by email on a durable medium. It contains at least the statement and the date and time when it was received. The system also provides a reference number. The acknowledgement confirms receipt; the Provider may assess the legal basis, effect and any refund separately. The online function does not restrict withdrawal by email or post.

7. Refund and access
Following a valid withdrawal or termination, the Provider applies the mandatory statutory rules, normally makes any refund due within 14 days after being informed, and may end future access. After exercising the right, the consumer must refrain from using the digital content or service and from making it available to third parties.
